Line Item: CCJJ Factual Innocence Payments

Function

As established in the Judicial Code, payments shall be made to petitioners who have been found to be factually innocent. The petitioner is entitled to receive for each year or portion of a year they were incarcerated, up to a maximum of 15 years, the monetary equivalent of the average annual nonagricultural payroll wage in Utah, as determined by the date most recently published by the Department of Workforce Services at the time of the petitioner's release from prison.

On September 12, 2011 the Third District Court in Salt Lake County ordered that $124,800 be paid to Mr. Harry Miller. According to the court order the first payment equal to $73,000 be paid within 45 days from the Crime Victim Reparations Fund. The remaining $51,700 will be paid in quarterly payments in accordance with state law. This General Fund appropriation of $51,700 should be made non-lapsing to comply with State law.

The $73,000 was appropriated as a supplamental amount during the 2012 General Session while the $51,700 was appropriated for FY 2013 and is recorded in the budget tables below.
