This bill replaces and clarifies Rule #63. The contracted indigent defense for those on death row would cost approximately $200,000 per year. These funds would be paid by the Division of Finance for indigent defense attorney services. Experience in other states, with similar provisions, suggests that the period between sentencing and execution would be reduced by approximately 3 years, saving the states approximately $66,000 in Corrections costs for the reduced length of stay for each condemed individual. Similarly, there would be some reduction in Federal appeals due to the provisions of this bill. Since such appeals would normally be answered by the Attorney General's Office, there is an additional potential savings in attorney expenses.
