This bill shifts the Indigent Inmate Defense Trust Fund from the Prosecution Council to the new Indigent Defense Fund Board and renames the fund. Two new funds are created, The Indigent Capital Defense Trust Fund and the Indigent Felony Defense Trust Fund. New funds created by legislative action will cumulatively cause increased workload in the Division of Finance and will require staffing and related costs sometime in the future. The bill appropriates $150,000 to the new funds. Local participation, and related costs, are discretionary with the local governmental entity. Under the bill, the newly created Board may request supplemental appropriations to cover deficits in the funds. Since the funds have references to fixed dollar amounts, there will be a potential for inflation erosion making the state, as final guarantor, subject to further requests for subsidy over time. Additional costs for staffing, board per diem and travel are estimated at $8,900 in General Funds per year.
