             6      This act modifies the Parks and Recreation Code. The act modifies the way proceeds
             7      from the sale or disposal of buffalo are deposited. The act creates the State Park Fees
             8      Restricted Account funded by State Parks and Recreation revenue. The act provides an
             9      effective date.
             10      This act affects sections of Utah Code Annotated 1953 as follows:
             11      AMENDS:
             12          63-11-19.2, as renumbered and amended by Chapter 93, Laws of Utah 1990
             13      ENACTS:
             14          63-11-66, Utah Code Annotated 1953
             15      Be it enacted by the Legislature of the state of Utah:
             16          Section 1. Section 63-11-19.2 is amended to read:
             17           63-11-19.2. Purchase, trade, sale, or disposal of buffalo -- Proceeds.
             18          (1) In accordance with a plan, approved by the Board of Parks and Recreation, for the
             19      management of buffalo herds on Antelope Island, the Division of Parks and Recreation is
             20      authorized to purchase, trade, sell, or dispose of buffalo obtained from Antelope Island through
             21      competitive bidding or any other means as established by rule. [Proceeds received from the
             22      sale or disposal of the buffalo shall be deposited as dedicated credits for Antelope Island
             23      buffalo management.]
             24          (2) [Subject to the limitations imposed in Subsection (3), proceeds] Proceeds received
             25      from the sale or disposal of buffalo under this section shall be deposited as [dedicated credits to
             26      be used by the Division of Parks and Recreation for the management of the buffalo herd on
             27      Antelope Island.] follows:



             28          [(3) No more than]
             29          (a) the first $75,000 [may] shall accrue to the Division of Parks and Recreation for the
             30      management of Antelope Island buffalo [management] herds as nonlapsing dedicated credits[.
             31      Any]; and
             32          (b) proceeds in excess [monies] of $75,000 shall be deposited in the [General Fund]
             33      State Park Fees Restricted Account created under Section 63-11-66 .
             34          Section 2. Section 63-11-66 is enacted to read:
             35          63-11-66. State Park Fees Restricted Account.
             36          (1) There is created within the General Fund a restricted account known as the State
             37      Park Fees Restricted Account.
             38          (2) (a) Except as provided in Subsection (2)(b), the account shall consist of revenue
             39      from:
             40          (i) all charges allowed under Subsection 63-11-17 (8); and
             41          (ii) proceeds from the sale or disposal of buffalo under Subsection 63-11-19.2 (2)(b).
             42          (b) The account shall not include revenue the division receives under Sections
             43      63-11-19.5 , 63-11-19.6 , and Subsection 63-11-19.2 (2)(a).
             44          (3) The division shall use funds in this account for the purposes described in Section
             45      63-11-17 .
             46          Section 3. Effective date.
             47          This act takes effect on July 1, 2003.
