             8      LONG TITLE
             9      General Description:
             10          This bill amends the Utah Emergency Medical Services System Act to prohibit
             11      ambulance and paramedic providers from charging fees for transporting a patient when
             12      there is no transport of the individual.
             13      Highlighted Provisions:
             14          This bill:
             15          .    amends the duties of the department regarding oversight of fees established by
             16      ambulance and paramedic providers;
             17          .    prohibits charging fees for transporting a patient for an ambulance or paramedic
             18      services when there is no transport of the individual; and
             19          .    allows a fee to be charged for responding to a call if the geographic service area of
             20      the ambulance or paramedic provider contains a town.

             29      Be it enacted by the Legislature of the state of Utah:


             30          Section 1. Section 26-8a-403 is amended to read:
             31           26-8a-403. Establishment of maximum rates.
             32          (1) The department shall, after receiving recommendations under Subsection (2),
             33      establish maximum rates for ground ambulance providers and paramedic providers that are just
             34      and reasonable.
             35          (2) The committee may make recommendations to the department on the maximum
             36      rates that should be set under Subsection (1).
             37          (3) (a) The department shall prohibit ground ambulance providers and paramedic
             38      providers from charging fees for transporting a patient when the provider does not transport the
             39      patient.
             40          (b) The provisions of Subsection (3)(a) do not apply to ambulance providers or
             41      paramedic providers in a geographic service area which contains a town as defined in
             42      Subsection 10-2-301 (2)(f).
