8 LONG TITLE
9 General Description:
10 This bill creates a grant program to minimize out-of-pocket expenses of licensed
11 teachers to obtain National Board certification or to take tests to meet federal highly
12 qualified teacher standards.
13 Highlighted Provisions:
14 This bill:
15 . directs the State Board of Education to give grants to school districts and charter
16 schools to pay costs directly related to enabling licensed teachers to obtain National
17 Board certification or to take tests to meet federal highly qualified teacher
18 standards;
19 . requires school districts and charter schools to provide matching funds to qualify for
20 a grant;
21 . specifies how grant monies may be used; and
22 . repeals the grant program on July 1, 2009.

24 This bill appropriates:
25 . $500,000 from the Uniform School Fund for fiscal year 2006-07 only, to the State
26 Board of Education.

28 This bill takes effect on July 1, 2006.

35 Be it enacted by the Legislature of the state of Utah:
36 Section 1. Section 53A-6-112 is enacted to read:
37 53A-6-112. Grants for licensed teachers.
38 (1) As used in this section:
39 (a) "Licensed teacher" means a teacher who holds:
40 (i) a level 1, level 2, or level 3 license; and
41 (ii) the endorsements required by board rule for the teacher's assignments.
42 (b) "National Board certification" means a current certificate issued by the National
43 Board for Professional Teaching Standards.
44 (2) A grant program is created to minimize out-of-pocket expenses of licensed teachers
45 to:
46 (a) obtain National Board certification; or
47 (b) take tests to meet federal highly qualified teacher standards as defined in 20 U.S.C.
48 Sec. 7801.
49 (3) The State Board of Education shall give grants to school districts and charter
50 schools for the purpose stated in Subsection (2) from monies appropriated by the Legislature
51 for that purpose.
52 (4) To receive a grant, a school district or charter school shall provide matching funds
53 to minimize out-of-pocket expenses of licensed teachers to obtain National Board certification
54 or to take tests to meet federal highly qualified teacher standards in an amount equal to the
55 grant.
56 (5) Grant monies and matching funds shall be used to pay for costs of licensed teachers
57 that are directly related to:
58 (a) obtaining National Board certification; or
59 (b) taking tests that, if the licensed teacher passes, the teacher meets federal highly
60 qualified teacher standards.
61 (6) The State Board of Education shall distribute money appropriated by the
62 Legislature to school districts and charter schools to pay for costs of licensed teachers directly
63 related to obtaining National Board certification or taking tests to meet federal highly qualified
64 teacher standards in accordance with:
65 (a) Subsection (4); and
66 (b) a formula adopted by the board, after consultation with school districts and charter
67 schools, that allocates the funding in a fair and equitable manner.
68 (7) The State Board of Education shall make rules in accordance with Title 63, Chapter
69 46a, Utah Administrative Rulemaking Act, to administer this section.
70 Section 2. Section 63-55b-153 is amended to read:
71 63-55b-153. Repeal dates -- Titles 53, 53A, and 53B.
72 (1) Subsection 53-3-205 (9)(a)(i)(D) is repealed July 1, 2007.
73 (2) Subsection 53-3-804 (2)(g) is repealed July 1, 2007.
74 (3) Section 53A-1-403.5 is repealed July 1, 2007.
75 (4) Subsection 53A-1a-511 (7)(c) is repealed July 1, 2007.
76 (5) Section 53A-3-702 is repealed July 1, 2008.
77 (6) Section 53A-6-112 is repealed July 1, 2009.

79 Section 3. Appropriation.
80 (1) There is appropriated $500,000 from the Uniform School Fund for fiscal year
81 2006-07 only, to the State Board of Education to distribute to school districts and charter
82 schools to pay for costs of licensed teachers directly related to obtaining National Board
83 certification or taking tests to meet federal highly qualified teacher standards.
84 (2) The money appropriated in Subsection (1):
85 (a) shall be used as provided in Section 53A-6-112; and
86 (b) is nonlapsing.
87 Section 4. Effective date.
88 This bill takes effect on July 1, 2006.
