CONCEALED WEAPONS FEES AMENDMENTS

             7      LONG TITLE
             8      General Description:
             9          This bill modifies provisions of the Concealed Weapons Act by creating a dedicated
             10      credit as a revenue stream to cover the costs incurred by the Criminal Investigations and
             11      Technical Services Division of the Department of Public Safety in issuing concealed
             12      S. [ weapons ] firearm .S permits.
             13      Highlighted Provisions:
             14          This bill:
             15          .    allows the Criminal Investigations and Technical Services Division to use fees
             16      collected for the issuance, renewal, and replacement of concealed S. [ weapons ] firearm .S
             16a      permits
             17      as a dedicated credit to cover the costs of issuing, renewing, and replacing those
             18      permits; and
             19          .    makes certain technical changes.
             20      Monies Appropriated in this Bill:
             21      S. [     None ] This bill appropriates:
             21a      as an ongoing appropriation subject to future budget constraints, a negative $653,900
             21b      from the General Fund and a positive $653,900 from dedicated credits for
             21c      fiscal year 2007-08 to the Bureau of Criminal Identification. .S
             22      Other Special Clauses:
             23           H. [ None ] This bill takes effect on July 1, 2007. .H
             24      Utah Code Sections Affected:
             25      AMENDS:
             26          53-5-707, as last amended by Chapters 120 and 227, Laws of Utah 1999

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 53-5-707 is amended to read:
             30           53-5-707. Permit -- Fees -- Disposition.
             31          (1) (a) Each applicant for a permit shall pay a fee of $35 at the time of filing an
             32      application.
             33          (b) The initial fee shall be waived for an applicant who is a law enforcement officer
             34      under Section 53-13-103 .
             35          (2) The renewal fee for the permit is $10.
             36          (3) The replacement fee for the permit is $10.
             37          (4) The late fee for the renewal permit is $7.50.
             38          [(5) All fees shall promptly be deposited in the state treasury and credited to the
             39      General Fund.]
             40          (5) S. (a) .S The division H. [ may ] shall .H use the fees collected under Subsections
             40a      (1), (2),
             40a      (3), and (4) as a
             41      dedicated credit to cover the costs of issuing concealed S. [ weapons ] firearm .S permits under
             41a      this part.
             41b      S.     (b) All revenue collected from the fees identified in Subsections (1), (2), (3), and (4) in
             41c      excess of the amount necessary to cover the cost of issuing concealed firearm permits under
             41d      this part shall be retained by the Bureau of Criminal Identification to help fund any other
             41e      costs incurred by the bureau, but only for the fiscal year 2007-08. .S
             42          (6) (a) The division may collect any fees charged by an outside agency for additional
             43      services required by statute as a prerequisite for issuance of a permit.
             44          (b) The division shall promptly forward any fees collected under Subsection (6)(a) to
             45      the appropriate agency.
             46          (7) The division shall make an annual report to the Legislature's Law Enforcement and
             47      Criminal Justice Interim Committee on the amount and use of the fees collected under this
             48      section.
             48a          H. Section 2. S. Appropriation.
             48b          (1) As an ongoing appropriation subject to future budget constraints, there is
             48c      appropriated from the General Fund for the fiscal year 2007-08, a negative $653,900 and from
             48d      dedicated credits for the fiscal year 2007-08, a positive $653,900 to the Bureau of Criminal
             48e      Identification within the Criminal Investigations and Technical Services Division of the
             48f      Department of Public Safety to cover the cost of the bureau's issuing concealed firearm
             48g      permits.
             48h          (2) The appropriations in Subsection (1) are in addition to amounts previously
             48i      appropriated to the bureau for the fiscal year 2007-08.
             48j          Section 3. .S Effective date.


             48k          This bill takes effect on July 1, 2007. .H
