             8      General Description:
             9          This bill amends the Health Code and creates a pilot program in the state's medical
             10      assistance program.
             11      Highlighted Provisions:
             12          This bill:
             13          .    requires the state Medicaid program to develop a community service pilot program
             14      as part of the state Medicaid plan;
             15          .    requires the Medicaid program to present the proposal for a community service pilot
             16      program to the Legislature's Health and Human Services Interim Committee; and
             17          .    requires the Medicaid program to submit a Medicaid waiver to the Centers for
             18      Medicare and Medicaid Services by January 1, 2012, to implement the community
             19      service pilot program.

             28      Be it enacted by the Legislature of the state of Utah:
             29          Section 1. Section 26-18-405 is enacted to read:


             30          26-18-405. Medicaid waiver for community service pilot program.
             31          (1) For purposes of this section, "community service pilot program" is a program in
             32      which the department:
             33          (a) identifies less than 100 Medicaid recipients who are capable of providing
             34      community services to others;
             35          (b) exempts a Medicaid recipient who is not capable of providing community services
             36      from the requirements of the community service pilot program;
             37          (c) identifies community services that the department will recognize for purposes of the
             38      pilot program; and
             39          (d) requires an individual identified under Subsection (1)(a) who is receiving Medicaid
             40      services to perform a certain number of hours of community service as a condition of receiving
             41      Medicaid benefits.
             42          (2) (a) The department shall develop a proposal to amend the state Medicaid plan to
             43      include a community service pilot program.
             44          (b) The department shall present the proposal for the community service pilot program
             45      to the Legislative Health and Human Services Interim Committee on or before November 30,
             46      2011.
             47          (3) The department shall, by January 1, 2012, apply for a Medicaid waiver with the
             48      Centers for Medicare and Medicaid Services within the United States Department of Health
             49      and Human Services to implement a community service pilot program within the state
             50      Medicaid plan.
