LONG TITLE
General Description:
This concurrent resolution of the Legislature and the Governor gives approval for the
construction and operation of a Class V commercial landfill to receive
asbestos-contaminated waste. The landfill is to be known as the Contract
Environmental Services Asbestos Landfill and is to be operated by Contract
Environmental Services, Inc.
Highlighted Provisions:
This resolution:
. provides that the landfill is to be located 19 miles north of Aneth, in San Juan
County, Utah;
. provides that the proposed landfill is to accept asbestos-contaminated waste as a
Class V landfill; and
. provides that the landfill permit was approved by the Department of Environmental
Quality on February 16, 2005, and will become effective March 1 of this year.
Special Clauses:
None
Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
WHEREAS, Contract Environmental Services, Inc. desires to operate a Class V
commercial landfill to receive asbestos-contaminated waste for treatment, storage, or disposal;
WHEREAS, the site of the proposed landfill is located 19 miles north of Aneth, in San
Juan County, Utah;
WHEREAS, the site of the proposed landfill is a parcel of approximately 80 acres,
located in Township 39 South, Range 26 East, Section 18;
WHEREAS, Section 19-6-108 of the Utah Code requires that the applicant for authority
to operate a commercial landfill must receive approval from the local government;
WHEREAS, Section 19-6-108 of the Utah Code also requires that an applicant for
authority to operate a commercial landfill receive approval from the Utah State Legislature and
the Governor of Utah as a part of the approval process;
WHEREAS, Section 19-6-108 also requires that an applicant for authority to construct
and operate a commercial landfill receive approval from the executive secretary of the Solid
and Hazardous Waste Control Board within the Department of Environmental Quality prior to
receiving legislative and gubernatorial approval and this approval was granted on February 16,
2005; and
WHEREAS, the permit for the Contract Environmental Services Asbestos Landfill will
take effect on March 1, 2005:
NOW, THEREFORE, BE IT RESOLVED by the Legislature, the Governor concurring
therein, that Contract Environmental Services, Inc., is granted approval by the Legislature and the
Governor to construct and operate a Class V commercial landfill to receive
asbestos-contaminated waste at the specified site to the north of Aneth in San Juan County, State
of Utah.
