             7      LONG TITLE
             8      General Description:
             9          This bill modifies the Utah Workforce Services Code by adding duties to the
             10      Department of Workforce Services related to reporting misuse of an individual Social
             11      Security number.
             12      Highlighted Provisions:
             13          This bill:
             14          .    requires the Department of Workforces Services to inform the owner of a Social
             15      Security number and an appropriate law enforcement agency if, in the process of
             16      determining an individual's eligibility for a public benefit, the department learns a
             17      valid Social Security number is being used by an unauthorized individual; and
             18          .    makes technical changes.
             19      Money Appropriated in this Bill:
             20          This bill appropriates:
             21          .    to the Department of Workforce Services, as an ongoing appropriation:
             22              .    from the General Fund, $10,000, subject to the intent language restricting the
             23      use of the funds for a specific purpose.
             24      Other Special Clauses:
             25          This bill takes effect on July 1, 2012.
             26      Utah Code Sections Affected:
             27      AMENDS:
             28          35A-1-104.5, as enacted by Laws of Utah 2008, Chapter 383

             30      Be it enacted by the Legislature of the state of Utah:
             31          Section 1. Section 35A-1-104.5 is amended to read:
             32           35A-1-104.5. Other department duties -- Strategic plan for health system reform
             33      -- Reporting suspected misuse of a Social Security number.
             34          (1) The department shall work with the Department of Health, the Insurance
             35      Department, the Governor's Office of Economic Development, and the Legislature to develop
             36      the health system reform in accordance with Title 63M, Chapter 1, Part 25, Health System
             37      Reform Act.
             38          (2) In the process of determining an individual's eligibility for a public benefit or
             39      service under this title or under federal law, if the department determines that a valid Social
             40      Security number is being used by an unauthorized individual, the department shall:
             41          (a) inform the individual who the department determines to be the likely actual owner
             42      of the Social Security number or, if the likely actual owner is a minor, the minor's parent or
             43      guardian, of the suspected misuse; and
             44          (b) subject to federal law, provide information of the suspected misuse to an
             45      appropriate law enforcement agency responsible for investigating identity fraud.
             46          (3) If the department learns or determines that providing information under Subsection
             47      (2)(b) is prohibited by federal law, the department shall notify the Legislative Management
             48      Committee.
             49          Section 2. Appropriation.
             50          Under the terms and conditions of Title 63J, Chapter 1, Budgetary Procedures Act, the
             51      following sums of money are appropriated from resources not otherwise appropriated, or
             52      reduced from amounts previously appropriated, out of the funds or accounts indicated for the
             53      fiscal year beginning July 1, 2012 and ending June 30, 2013. These are additions to any
             54      amounts previously appropriated for fiscal year 2013.
             55          To Department of Workforce Services
             56              From General Fund                            $10,000
             57              Schedule of Programs:


             58                  Unemployment Insurance            $5,000
             59                  Eligibility Services                $5,000
             60          The Legislature intends that the appropriations under this section be used by the
             61      Department of Workforce Services to report suspected misuse of Social Security numbers as
             62      provided under Section 35A-4-312.5 and Subsection 35A-1-104.5 (2).
             63          Section 3. Effective date.
             64          This bill takes effect on July 1, 2012.
