Chair Christensen called the meeting to order at 8:22 a.m.
Approval of Minutes
Rep. Ray moved to approve the minutes of the January 29, January 30, and February 5, 2019 meetings.
Unfinished Items from the Previous Agenda
3a-RFA - Pitcher - Victim Address Confidentiality Program
Rep. Stephanie Pitcher explained the program and its costs.
Ms. Darcy Goddard, Chief Policy Advisor, Salt Lake County District Attorney's Office, gave additional information to the committee.
Rep. Ray asked for more information regarding the use of post office boxes.
Sen. Escamilla asked about confidentiality and Ms. Goddard responded.
Chair Christensen asked about the ongoing and one-time requests.
Rep. Ray asked for additional information on the funding for the program and Rep. Pitcher responded.

Chair Christensen explained a change on the one-time state funds list.
Rep. Seegmiller moved to change CK - DWS - United Way of Northern Utah Community Resource Building - on the one-time sheet from $250,000 to $200,000.
Sen. Hemmert moved to combine ongoing EP - DOH - Accountable Care Organization Funding - with item EF - DOH - Medicaid Managed Care Additional 2.0% Reimbursement - and include the following intent language: "If the Utah Legislature increases funding for Accountable Care Organizations those increases should be passed on to the respective clinical providers and not be used for administrative functions."
Rep. Thurston asked for clarification on the funding increases and Sen. Hemmert and Chair Christensen responded.
Sen. Escamilla asked for additional clarification.
Rep. Ward spoke against the motion.
Rep. Seegmiller spoke against the motion.
Sen. Hemmert's motion
Rep. Judkins moved to place AC - DOH - Medicaid Management Information System Replacement Cost Overruns - to the bottom of the list on the one-time sheet.
Chair Christensen opposed the motion.
Rep. Ward made a point of order about Rep. Judkins being allowed to speak to her motion before committee discussion.
Mr. Nate Checketts, Deputy Director, Department of Health (DOH), said he is not opposed to the motion but they will need the funds eventually.
Chair Christensen said he no longer opposes Rep. Judkins' motion.
Rep. Judkins' motion
Rep. Daw moved to place item EN - DOH - Update of Physical/Occupational Therapy Medicaid Payments, and item EO - DOH - Home Health Care Services, above item FE - DHS - Disability Services: Community-Based Employment - on the ongoing sheet.
The motion
Rep. Robertson moved that item EF - DOH - Medicaid Managed Care Additional 2.0% Reimbursement - and item EP - DOH - Medicaid Accountable Care Organization Funding - on the ongoing list, have the following intent language included: "If the Utah Legislature increases funding for Accountable Care Organizations those increases should be passed on to the respective clinical providers and not be used for administrative functions."
Rep. Thurston moved to reduce item FK - DHS - Children's Service Society - Grandfamilies Kinship Program - to $500,000 dollars and move it up to just below item EH - DOH - Porcelain Crown Dental Coverage for Medicaid Clients - on the ongoing sheet.
Rep. Ray said the organization was fine with the reduction in funding.
Rep. Dailey-Provost also said the organization was fine with the funding decrease but she expressed concern with the amount of the decrease.
Rep. Thurston's motion
Rep. Thurston moved to reduce item GE - Inter-generational Poverty Earned Income Credit and Education Savings Incentive Program - on the ongoing list, from $6,000,000 dollars to $900,000 dollars and move up to below item EO - DOH - Home Health Care Services - and add a note to Executive Appropriations that this could conceivably be funded with one-time money if they chose to do that.
Sen. Escamilla moved to move FN - DHS - Disability Services Direct Care Staff Salary Increase - to below FF - DHS - Disability Services: Add Nursing Services Benefits - on the ongoing sheet, and adding to the $1.5 million dollars for FN the following: $154,800 dollars, which will go to direct care staff in ICF-IDs; and $72,600 dollars, which will go to the Utah State Developmental Centers, for a total request of $1,727,400 dollars.
Rep. Judkins asked how much salaries would be if the request for increased funding is granted. Chair Christensen responded.
The motion
Rep. Daw moved to move item CJ - DWS - Work is the Way - to above item BJ - DHS - Carbon County Transitional Center - on the one-time sheet.
Rep. Dailey-Provost moved to move item FF - DHS - Disability Services: Add Nursing Services Benefits - to below item EV - DOH - Dental Provider Reimbursement - on the ongoing sheet.
Rep. Ward moved to move item FF - DHS - Disability Services: Add Nursing Services Benefits - to position 40, move item ED - DOH - Loan Repayment Incentives for 7 Medical Providers in Underserved Areas - to position 18, and move item EM - DOH - Lower Cremation Fee, Fund Medical Examiner with General Fund - to position 19 on the ongoing sheet.
Rep. Ray spoke in support of the substitute motion and asked for clarification of the cremation fee and Rep. Ward and Mr. Frandsen responded.
Rep. Dailey-Provost spoke in opposition to the substitute motion.
The substitute motion
Chair Christensen moved to delete item EH - DOH - Porcelain Crown Dental Coverage for Medicaid Clients - from the ongoing list.
Sen. Weiler moved to move item GB - DWS - Homeless Case Management through Pamela Atkinson Account - to position #8 on the ongoing sheet.
Chair Christensen said he would support the motion if the item was moved to line eight instead of line three and Sen. Weiler agreed.
Rep. Coleman also spoke in support of moving the item to line eight.
Rep. Hollins also spoke in support of moving GB to line eight.
Chair Christensen gave information about funding some of the items.
The motion
Sen. Weiler moved to move GC - DWS - Dignity of Work Programs for Operation Rio Grande - on the ongoing sheet to line nine.
Rep. Thurston moved to reduce GE - DWS - Intergenerational poverty earned income credit - on the ongoing list, to $950,000 dollars, and move it to below CJ - DWS - Work is the Way - on the one-time list.
Rep. Robertson moved to move BK - DHS - Youth Edification Equine Human Association and Alliance - to second from bottom above AC - DOH - Medicaid Management Information System Replacement Cost Overruns - on the one-time sheet.
Rep. Coleman moved to move FN - DHS - Disability Services Direct Care Staff Salary Increase - Phase V - on the ongoing sheet, to above FE - DHS - Disability Services: Community-Based Employment.
Rep. Coleman moved if the Legislature does not pass H.B. 342, Homeless Provider Oversight Amendments, then the following intent language is approved: "The Legislature intends that the Legislature consider clarifying in statute the responsibilities of the State Homeless Coordinating Committee, consider requiring the State Homeless Coordinating Committee to adopt a statewide strategic plan for reducing homelessness in the state, require the State Homeless Coordinating Committee to develop a system for monitoring the extent to which the goals and strategies described in the strategic plan have been achieved, and consider requiring the State Homeless Coordinating Committee to report progress towards achieving goals described in their strategic plan, and that the State Homeless Coordinating Committee designate local oversight bodies that are responsible to develop a common agenda and vision for reducing homelessness in that region, craft a spending plan that coordinates the funding supplied by local stakeholders, monitor the progress toward achieving state and local goals, and realign funding to those projects that are improving their outcomes and targeting specific needs in the community."
Chair Christensen spoke in support of the motion.
Rep. Thurston asked for information on intent language.
Rep. Ray provided information about intent language and a bill file. Rep. Thurston asked about including a coordinating clause in the motion.
Rep. Ray suggested waiting to see if Sen. Anderegg's bill passes and then decide if the motion should be intent language or go into the Bill of Bills.
The motion
Rep. Ward moved to move ER - DOH - Spinal Cord and Brain Injury Rehabilitation Fund - and FS - DHS - Medicaid Assisted Treatment - from the ongoing sheet to the one-time sheet below AE - DOH - Maternal Mental Health Support (FY 2019).
Rep. Robertson asked for clarification of the motion and Rep. Ward responded.
The motion
Rep. Hollins moved to move FR - DHS - Children Reunifying in Residential Treatment Programs - to above EG - DOH - Quality Improvement Incentives for Intermediate Care - on the ongoing list.
Chair Christensen made note that moving items up on the list would push down other very important items and spoke in opposition to the motion.
Rep. Thurston agreed with Chair Christensen.
The motion
Rep. Thurston moved to move item BI - DHS - Domestic Violence: Victim Address Confidentiality Program - down to just above BK - DHS - Youth Edification Equine Human Association and Alliance - on the one-time list.
Chair Christensen provided information about the item in the motion.
Rep. Judkins moved to move FJ - DHS - Child and Family Services Caseworkers, FO - DHS - Disability Services: Motor Transport Payment Rate Increase, and FP - DHS - Disability Services: Support Coordinator Rate Increase - up to just below DE - DOH & DHS - Mental Health Crisis Receiving Centers - on the ongoing list.
Chair Christensen spoke about the items being moved and Rep. Judkins explained her reasoning.
Rep. Ray expressed his concerns with some of the items that will be pushed down the list.
Rep. Thurston commented about the possibility of general funds being available.
The motion
Sen. Hemmert moved to move FO - DHS - Disability Services: Motor Transportation Payment Rate Increase - to below EC - DOH - Funding to Local Health Departments for Compliance - on the ongoing sheet and reduce EC to 500,000 dollars.
Sen. Hemmert moved to approve the ongoing sheets and one-time sheets as amended.
Sen. Escamilla spoke in opposition to the motion.
Rep. Ward moved to delete AF - DOH - Health Care Work Force Assistance (FY 2019) and CG DWS - Intergenerational poverty earned income credit and education savings incentive program - from the one-time sheet.
Rep. Ray moved to accept the sheets for the one-time and the ongoing building blocks as amended.
Sen. Escamilla moved to add, as the last item on the ongoing list, $227,400 dollars to provide similar staff salary increases for ICF-IDs and USDC as provided in FN - DHS - Disability Services: Direct Care Staff Salary Increase - Phase V.
Rep. Ray spoke in opposition to the substitute motion.

Rep. Daw moved that: The Utah Department of Health Division of Medicaid and Health Financing shall share with accountable care organizations the review date information of enrolled members, if requested by the accountable care organization for use in accordance with Department of Health guidelines.
Rep. Thurston moved to adjourn.
