FY 2016 Appropriation

Administration oversees and manages the department and includes: centralized accounting, payroll, personnel, and budget functions.

The mission of the administrative office "is to provide administrative support (financial, human resources, information technology, public relations, and adjudicative) to the divisions within the Department of Commerce. The Department of Commerce administrative office is also responsible for the administration of the Motor Vehicle Franchise Act, Power Boat Franchise Act, and the Office of the Property Rights Ombudsman."

Appropriation Overview

During the 2015 General Session, the Legislature appropriated for Fiscal Year 2016, $3,572,500 from all sources for Administration. This is a 1.1 percent increase from Fiscal Year 2015 revised estimated amounts from all sources.

Enactment of this bill could reduce annual year-end transfers to the General Fund by $8,800. Enactment of this legislation could cost the Department of Commerce $8,800 from the Commerce Service Fund for additional administrative law judge time to meet the new deadlines. Spending from the Commerce Service Fund impacts year-end transfer tot he General Fund.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the Department of Commerce, Division of Public Utilities in Item 22 of Chapter 10, Laws of Utah 2014, lapse to the Divisions' Professional and Technical Services Fund at the close of Fiscal Year 2015.


Department funding is primarily from the Commerce Service Fund which is made up from fees collected by the department. By statute, funds collected to the Commerce Service Fund over the amount appropriated to the department are deposited in the General Fund. The department also receives revenue from Dedicated Credits, Restricted/Enforcement Funds, and Federal Funds.
