The role of the Governor's Office of Economic Development is to facilitate the growth of quality jobs, promote Utah business, and develop economic prosperity for Utah by increasing the net tax revenue to the State.

Funding Issues

Avenue H

Avenue H is Utah's small business health exchange program. The program has been funded on a one-time basis for the past several years. Last years funding was $800,000.

Business Marketing

GOED received both ongoing and one-time funds for business marketing. This recommendation would eliminated the ongoing funds and look at replacing them with one-time funds through committee reallocations.

Business Resource Centers

Business Resource Centers are certified one-stop resource centers providing coordination of business support, education, tracking of clients, access to sources of funding, training, technical expertise, talent, and networking for new and existing businesses.

Compliance Staff for Incentives

Contract workload for incentives is increasing as the GOED board issues new incentives each year. Additional staff could help ensure that the companies receiving the incentives are complying with their contractual obligations.

Industrial Assistance Fund Replenishment

The Industrial Assistance Fund is set up as a post performance grant program. As credits are earned they are aggregated for an annual replenishment. Funding is set aside from the General Fund Surplus in years where there is a surplus.
Appropriation Overview

During the 2015 General Session, the Legislature appropriated for Fiscal Year 2016, $61,440,500 from all sources for Economic Development. This is a 34.8 percent reduction from Fiscal Year 2015 revised estimated amounts from all sources. The total includes $33,583,200 from the General/Education Funds, a reduction of 36.9 percent from revised Fiscal Year 2015 estimates.

Statute

Statutory authority for the Governor's Office of Economic Development is provided in UCA 63M-1. GOED shall:

  • Be the industrial promotion authority of the state;
  • Promote and encourage the economic, commercial, financial, industrial, agricultural, and civic welfare of the state;
  • Create, develop, attract, and retain business, industry, and commerce within the state; and
  • Enhance the economy of the state.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the Governor's Office of Economic Development Administration in Laws of Utah 2014, Chapter 10, Item 8 shall not lapse at the close of FY 2015. The use of any non-lapsing funds is limited to system management enhancements: $200,000; business marketing efforts: $300,000; and health system reform: $700,000.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the STEM Action Center in Laws of Utah 2014, Chapter 10, Item 9 not lapse at the close of FY 2015. The use of any non-lapsing funds is limited to STEM Center Administrative activities: $2,000,000.

Under Section 63J-1-602.4 of the Utah Code, the Legislature intends that appropriations provided for the Motion Picture Incentive Fund shall not lapse at the close of FY 2015. The use of any non-lapsing funds is limited to $5,000,000.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the Governor's Office of Economic Development Business Development, Laws of Utah 2014, Chapter 10, Item 11 shall not lapse at the close of FY 2015. The use of any non-lapsing funds is limited to Business Cluster support: $75,000; Business Resource Centers: $350,000; Technology Commercialization and Innovation Program contracts: $3,000,000; International Development contracts and support: $500,000; Procurement and Technical Assistance Center contracts: $175,000; Rural Development contracts and support: $200,000; and Corporate Recruitment contracts and support: $100,000.

Under Section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided for the Pete Suazo Utah Athletic Commission in Laws of Utah 2014, Chapter 10, Item 12 shall not lapse at the close of Fiscal Year 2015. The use of any non-lapsing funds is limited to the Pete Suazo Utah Athletic Program: $175,000.


SB0002: Item 57

The Legislature intends that $240,000 of the one-time appropriation in Administration be used for the Sichuan Province Partnership. The Legislature intends: (1) this appropriation is nonlapsing; (2) GOED ensure that this appropriation is spent to create and organize a legal entity to promote business, education, and investment between Utah and Sichuan, China; (3) GOED may delegate the task of creating and organizing the entity to the World Trade Center Utah; (4) in creating and organizing the entity, GOED shall consult with the World Trade Center Utah, the co-chairs of the Business and Labor Interim Committee, and the co-chairs of Utah International Relations and Trade Commission; (5) GOED may only release monies to the entity after it is legally created; and (6) the new entity, with the assistance of GOED and World Trade Center Utah shall: (a) report to the Business and Labor Interim Committee, and the Utah International Relations and Trade Commission by October 31, 2015; (b) provide an accounting of the expenditure of this appropriation; and (c) provide proposed legislation to that committee and commission to formally create, or authorize the creation of, the entity in statute.

The Legislature intends that up to $4,000,000 of the Industrial Assistance Fund allocation to economic opportunities be allowed as incentive for a television series.

The Legislature intends that $3,000,000 provided by this item be used to support the Mountain Accord and that, under section 63J-1-603 of the Utah Code, up to $3,000,000 not lapse at the close of fiscal year 2015.

Special Funds

The Governor's Office of Economic Development administers the following special funds:

The Industrial Assistance Fund is funded through contingent appropriations from the General Fund. Funding is used to pay for post-performance grants issued by the Board of Business and Economic Development.

The Tourism Marketing Performance Fund is funded through a sales tax earmark of 21 NAICS codes. Funds are increased as certain growth levels are met. Funding is used in three ways: Advertising, Co-op program and to fund the Utah Sports Commission.

The Motion Picture Incentive Fund receives funding from the General Fund. Funds are used to provide grants to motion pictures meeting the criteria established in statute.
