FY 2016 Appropriation

The Judicial Performance Evaluation Commission collects and analyzes data on the performance of judges in Utah. The commission uses this information to prepare reports on the performance of judges standing for retention election. Summaries of these reports are published in the voter information pamphlet and on a dedicated website. The commission also makes recommendations on whether judges should be retained.

Appropriation Overview

During the 2015 General Session, the Legislature appropriated for Fiscal Year 2016, $476,700 from all sources for Judicial Performance Evaluation Commission. This is a 16.9 percent reduction from Fiscal Year 2015 revised estimated amounts from all sources. The total includes $476,700 from the General/Education Funds, an increase of 3.1 percent from revised Fiscal Year 2015 estimates.

This measure is tied to the statutory requirement that JPEC create a website from which citizens can access judicial evaluation reports prior to a general election. JPEC uses the website as the main portal for disseminating information about judicial performance evaluations to the public.

The commission is created in UCA 78A-12-201 with 13 members. The requirement to prepare performance evaluations begins with the 2012 judicial retention elections. The commission may consider:

  • The most recent judicial performance survey
  • Compliance with minimum performance standards
  • Courtroom observations
  • The judge's judicial disciplinary record, if any
  • Public comment solicited by the commission
  • Information for an earlier judicial performance evaluation
  • Any other relevant factor the commission establishes by rule

Under section 63J-1-603 of the Utah Code, the Legislature intends that appropriations provided to the Commission on Criminal and Juvenile Justice in Item 19, Chapter 14, Laws of Utah 2014 not lapse at the close of Fiscal Year 2015.
