State Tax Commission Updates to Unrelated Business Income Classification

Jason Gardner, Deputy Executive Director, and Rebecca Rockwell, Commissioner, State Tax Commission, discussed proposed changes to corporate tax filings regarding unrelated business income on nonprofit entities and responded to questions from the committee.
Public comment was heard from Steve Young, state and local tax attorney, on the proposed changes.
Election Systems: Administration, Oversight, and Signature Verification
Reed Galen, Summit County resident, and Robert Dana Williams, former mayor of Park City, discussed a recent occurrence involving the issue of form requirements for petitions.

Chris Williams reviewed the current statute regarding the manual referendum process.
3 - Letter from Summit County on Ordinance 987
Frank Pignanelli, Fox and Pignanelli, representing Summit County, referred committee members to the official letter from Summit County, which explained how the current law was applied by the county clerk.
Public comments on the issue were heard from:
Jimmy May; and
Angela Moschetta.
Sen. McCay moved to open a committee bill file to address the petition and citizen initiative process.

Chris Williams discussed the differences between the regular rulemaking and emergency rulemaking processes.
Rohnin Randles provided background on two emergency rules, R105.5, White Collar Crime Registry and R105.6, Child Protection Registry, from the Attorney General's Office.
Paul Tonks, Assistant Attorney General, and Mike Broschinsky, Director, Office of Administrative Rules, addressed the circumstances that necessitated emergency rulemaking to address the White Collar Crime Registry and the Child Protection Registry and responded to questions from the committee.
Emergency Rules Oversight: Division of Risk Management
Rohnin Randles introduced emergency rule, R37-4, Adjusted Utah Government Immunity Act Limitations on Judgments, from the Division of Risk Management.
Dennis Flynn, Assistant Utah Attorney General, Division of Risk Management, discussed the circumstances that necessitated emergency rule R37-4, Adjusted Utah Government Immunity Act on Limitations and Judgments, and responded to questions from the committee.
Review of Administrative Procedures Act: Mayhew v. Labor Commission
This agenda item was not discussed. Chair Walter indicated that it will be moved to the next meeting agenda.
