FY 2016 Appropriation

Article 10, Section 3 of the Utah Constitution states "The general control and supervision of the public education system shall be vested in a State Board of Education." Further, the Constitution reads the "State Board of Education shall appoint a State Superintendent of Public Instruction who shall be the executive officer of the board." The Board and its appointed Superintendent administer the various operating programs and divisions supporting Utah's public education system.

The State Board adopted "Promises to Keep" as its mission and vision in guiding and overseeing Utah's education system. Specifically, the mission of public education is to "keep its constitutional promise by: ensuring literacy and numeracy for all Utah children; providing high quality instruction for all Utah children; establishing curriculum with high standards and relevance for all Utah children; and, requiring effective assessment to inform high quality instruction and accountability." The Board consists of 15 elected members. The State Board of Regents, which governs the State's higher education system, appoints two Regents to participate as non-voting members of the State Board of Education. Accordingly, two members of the State Board of Education participate as non-voting members of the State Board of Regents. In addition to these members, representatives of the Coalition of Minorities Advisory Committee, Utah College of Applied Technology, State Charter School Board, and the Utah School Board's Association act as advisories to the Board. Enrollment growth necessitates expansion to more classrooms in the Orem area. Students there are experiencing overcrowding in existing structures. The modular classrooms will ensure adequate space to promote the essential learning environments for a USDB student. Additionally, this builds the capacity of USDB to provide Free and Appropriate Public Education (FAPE) as mandated by the federal law, IDEA, to special education students in the State. 60 x 69 = 4,140 sq ft. Consists of: 6 classrooms, 2 storage rooms, 2 restrooms (1 men/1 women), 1 utility room or staff restroom, 1 kitchenette/break room, and 2 offices.

Teacher Steps/Lanes USDB

USDB: Annual salary adjustments for educators. The amount includes a .4334 increase of the overall steps and lanes salary table.

USIMAC (Braille Publishing)

USIMAC (Utah State Instructional Materials Access Center) is requesting these positions to ensure that the center provides materials for all students with print disabilities who are qualified under the Chafee Amendment or otherwise eligible through an IEP. This request is for four FTEs: 2.0 - instructional media specialist I (not certified) 2.0 - instructional media specialist II (certified)

USIMAC Braille Embossers (with 7788)

Funding request is for three braille embossers. Current machines have reached their life cycle limits.

During the 2015 General Session, the Legislature appropriated for Fiscal Year 2016, $661,364,000 from all sources for State Board of Education. This is a 3.3 percent increase from Fiscal Year 2015 revised estimated amounts from all sources. The total includes $112,863,500 from the General/Education Funds, an increase of 23.5 percent from revised Fiscal Year 2015 estimates.

The new Salt Lake Center is tasked to be an early intervention center focused on the four types of education and community support provided by USDB: blind/visually impaired, deaf/hard of hearing, deaf-blind, and parent infant programs. The project will be constructed on land USDB already owns at 1655 E 3300 S and will allow USDB to provide services to students located in the Salt Lake region, with enough space for anticipated growth. The facility will also resolve current space inadequacies and eliminate the requirement for excessive and frequent relocation of classrooms in the Salt Lake area (10 student classrooms). The building will be equipped with sensory accomodations, lighting, and acoustical considerations. The building will be approximately 48,500 square feet. Prioritized #3 by the IGG subcommittee and #6 by the Building Board. Estimated O&M is $45,000.

The Legislature intends that the Utah State Board of Education use the revenue bond savings of $264,700 from the Education Fund to support a portion of their Risk Mitigation Plan.


The Education Fund was established during the 2006 General Session of the Legislature. House Bill 294 stated that the "Education Fund shall receive all revenues from taxes on intangible property or from a tax on income and shall be designated for public and higher education" (H.B. 294, 2006 General Session). The Education Fund and the General Fund are the two major revenue funds supporting state expenditures.

State funds supporting the public education system come primarily from the Education Fund with the Uniform School Fund (USF) contributing to the Basic School Program in the Minimum School Program. The USF is a special revenue fund that "accounts for all revenues that are required by law to be expended for the public school programs of the state" (UCA 51-5-4).

Historically, the Education Fund and Uniform School Fund have contributed approximately 70 percent of the total revenue that supports the state appropriated public education budget. The other major revenue sources include the Local Property Tax, which contributes approximately 17 percent of the total revenue, and Federal Funds contribute about 10 percent. Other minor revenue sources contribute the remaining three percent to the budget. School districts and charter schools have additional revenues available to them outside the state appropriated budget. For school districts, these additional revenue sources are generated through levying local property taxes.

Three main expenditure categories comprise Utah's public education system. The largest expenditure program in the State budget is the Minimum School Program (MSP). The MSP has total expenditures nearing $3.4 billion and supports the State's school districts and charter schools. In addition to the MSP, which supports school district operations, the Legislature provides funding for the School Building Program. The School Building Program helps support school building construction or renovation in the districts. Finally, the Public Education Agencies represent state-wide programs that support the education and development of students.
